Speaking in his weekly radio address, President Mohamed Nasheed has said he is hopeful the new penal code will exclude the penalties of death and amputation.
After debate, the People’s Majlis sent the revised draft penal code to an ad hoc committee for further review, on Wednesday.
On death penalty, the President said: “A fair, a very fair trial – in my view as fair as the justice delivered during the Prophetic era – must be ensured before taking human life.
“I don’t believe that the Maldives’ judicial system has the capacity to meet all requirements for such a fair trial. Ultimately, the burden of pardoning or the burden of implementing death penalty is upon the President.”
The President said, in his opinion, it was unwise to make death penalty a codified punishment in law.
“I’m hopeful the penal code would be passed without offences punishable by death,” said the President.
Speaking on amputation, the President said amputation as a penalty has never been the common practice in the Maldives.
He said the consequences of the only two instances of implementing amputation in the past were negative and bad.
“I don’t think the penal code should include amputation as a penalty,” said the President.
Underwater cabinet meeting
In his radio address, President Nasheed spoke on the underwater cabinet meeting to be held at Girifushi tomorrow.
He said the underwater cabinet meeting will be a significant achievement in drawing the world attention to the Maldives’ efforts to address climate change.
The President said: “It’s crucial that the voice of Maldives’ politicians – or the cabinet – be heard throughout the world. This is because of the threat posed to the Maldives from climate change”
He further said a dialogue between the Maldives and the rest of the world must be started. The underwater cabinet meeting, the President said, would facilitate such a dialogue by attracting the world attention on the Maldives.
“There is hardly any news media that have not talked about this event,” said the President.
Some of the major international media outlets are in the Maldives to cover the event. Television Maldives will broadcast the meeting live around 10 o’clock in the morning.
President Nasheed, including the cabinet, will hold a press conference after the dive.
Bill on former presidents
In the radio address, the President also spoke on the bill on the privileges and immunities of former presidents, which was passed on Tuesday.
Referring to the controversial “Article 9” which was ultimately removed, the President said it was unacceptable that any citizen had the immunity from being tried in a court of law.
The bill provides for pension and other allowances for former presidents.
President Nasheed also reiterated a theme he has raised on several occasion. He said former presidents should remain as former presidents should they wish the respect and admiration of the people.
“If former presidents become opposition political leaders, the respect and admiration they get will be on that capacity,” said the President.
In his radio address, the President highlighted on his trip to Laamu atoll, his scheduled visit to India on 21 October, on the World Food Day, which is being marked today, and on government’s decision to make a claim for an extended continental shelf for the Maldives.
The cabinet in a meeting on Tuesday decided to explore the possibility of having an extended continental shelf for the Maldives.

DDRP/PA and Umar Naseer will be supported by religious extremists in this debate. If we allow the death sentence and amputations it will be equal to Talibanization of the Maldives and many more draconian laws, rules and regulations will follow.
Should such a law be passed President Nasheed should not sign it for many reasons and insist that only 2/3 majority of Majlis overriding his veto could make that law in the Maldives. We the public who did not vote a single openely contesting self-declared Mullah into parliamnet will be watching how this plays out and will be able to identify which closet Mullahs should be voted out of parliament next time.
This type of law cannot be even contemplated without a national referrendum, if at all.

For a number of reasons, including possible manipulation of the judiciary by politicians or other power brokers, there is no absolute guarentee one will have a completely fair trial in a court of Law.
Therefore, it would be a brutal betrayal of the deeply Just essence of Islam to have the death penalty (Hadd) applied in the Maldves.
The word Adhaalath, most often translated as justice, can also be translated to mean equity - fairness, an even distribution of something. It implies what we would call social justice, equality before the law of all, and absolute objectivity in the implementation of any Hakm (law).
I hereby plead with the Adhaalath party and with all Muslims to consider this.
On many occassions, the Prophet (SAW) did not implement the death penalty (Rajm) for certain Hadd level crimes although other's frantically pushed for it to be implemented. This was because, absolute objectivity could not always be guarenteed in the decision making procedure.
For example, in the Hadith's of Bukhari and Muslim, as narrated through Sahih Isnad (reliable chain of narration) we read about some Muslim's killing other Muslims because they were 'not Muslim...' They said Shahada only at the edge of the sword, it was claimed. In response to the claim that their Shahada was not genuine, the Prophet (SAW) said, "Did you cut their hearts open to see the Niyat (the quality of intention) of their hearts?' The point being, if there is any chance that there could be a mistake, then only Allah (SWT) can judge in the Qiyamath, the judgement which is in the Akhira - the after life. Unless absolute objectivity can be guarenteed, the Prophet did not implement or advise Hadd.
On other occassions, according to Sahih Isnad in Bukhari and Muslim, it was obvious that a child was not the child of the Father who thought they were the Father. For Malsahah (social utlity) the Prophet (SAW) said, the Child belongs to whose bed on which it was born. It was not beneficial to prescribe Hadd though it was technically due. The Merciful essence of Islam and the Islamic intent of social harmony, social justice, would be betrayed by Hadd in such circumstances although Hadd was techically due.
Application of Shariah always gives the benefit of the doubt, very rarely was Hadd applied by the earliest Muslims and Madhab, it was Sunnah to give the benefit of the doubt.
So, I plead, for the cause of justice, please ask yourself, would it be true to justice to trust a Maldivian Judge with the application of the death penalty?
I say, No, it is not islamic to apply death penalty in Maldives.
Very sad to say I cannot support President Nasheed`s view on this. Its high time such laws to be implimented. We have to know we cannot be better than our Creater. Those laws are laws of the Creater. Fact is Islam has more than 2 dozen theological interpretations, 2 major deviations, Shia and Sunni, 4 major sects, at least 6 subsets of each and Sufism and people who don't believe in Imams and Mullahs just like all good Muslims for almost 4 centuries after the death of a Man Called Mohamed who said he was just a Fallible Man and should be treated as Just Another Man. He told each and everyone of us to seek the truth for ourselves, and prohibited a Priesthood in Islam.

i will never agree with what president said. the islamic sharia is revealed from the Almighty who knows what is best for the mankind. What if your children were put to death for a crime that was made up – false? False charges occur very frequently in Maldives. What if the drug dealers and corrupt ones who control the courts killed your Son or daughter on charges of “terror” or manufactured charges of murder, Zina or anything – but all your children really did was try to prevent the drug dealers from harming the ppl – and were killed for that based on some false charges made up that they committed zina?
I by no means say that the death penalty is not part of the Sacred Law. Indeed, I also really believe that drug dealers and those murderers deserve the death penalty, as per the Qur’an and the Shariah Law. Especially those who have harmed children or who have harmed the sacred trust between parent and child, they must die.
However, I fear implementing the death penalty in Maldives will not see the real criminals killed, but will see the innocent killed by the criminals who control the courts. Implementing the death penalty in the Maldives will amount to a grave oppression – a grave injustice – and that is Haram! That is why I argue, it is not true to the Just essence of Islam to apply the death penalty in the Maldives.
As the Ummah is as one body, and one feels the pain of every other– I cannot but help fend for the potential victims of injustice under a system which MAY see the rich and powerful use the death penalty to exterminate their enemies unjustly.
Think about all those who stood up against tyrants in Maldivian history, imagine if they had of been killed by the State in the Name of Islam even though they were fighting for True Islam which is Peace and Submission to the Just Will of Allah…- I mean – how many crimes were manufactured against them? They would have been killed if the government’s (Sultan’s – Presidents) could have done so – .

In the the current system… The real criminals walk away from the courts – in fact control the courts, and that does not look like it can be changed! So, the killers and the drug dealers will be killing the innocent and oppressed in the name of implementing Islamic Law, does that sound like Islam to you? That is serious Fitnah (dissension) from Islam…
Of course, the death penalty was practiced by Our Beloved Rasul (SAW) and is ordered by the Qur’an. The issue is, the reliability of the current system. Shariah Law – the Hukm (Law) is deeply sacred, it is a massive Amanah (trust) which must never be taken lightly or under estimated. Allah is Al Quddus, the Holy, and every injustice is made right in the Qiyamat. Read the Hadith about what is in store in Jahannum for Muslim leader’s who missapply the Shariah Law for political ends or for the wrong Niyat. The Judge who orders a death is to be held accountable for his motives, it is a massive Zalim to missapply the Hudud. I do advise anyone wishing to implement the Law to be aware not to play politics with the Sacred Law.
A Qadi must be a qualified Mujtahid and must investigate the issue extensively before making a decision to kill someone. Notice the word Mujtahid, notice how this word for study and decision making about the Law requires Jihad – as is contained in the word. If he exhausts all avenues of possible doubt, only then will he be rewarded for decision making, and those doubts include ones own heart’s doubts!
I would like to see the Sheikhs and defenders of Islam comment on this notion that a Good Judgement will be Rewarded by 2 Sawaab and an Erronous Judgment by a Judge(gazi) will be Rewarded with 1 Sawaab. If that is so this Sharia business should be brought to an end once and for all. We are willing to listen and learn only to Justics...don't give me the nonsense that God does some crazy and unfair things in mysterious that will have a good side to it that we may not understand crap...crap is crap...n justice is justice and God gave us a brain and allowed to reason out logically.
