The recent news that an 18 year old girl fainted whilst being flogged in the Maldives has been an issue of serious controversy. A large portion of the public expressed their outrage over the case, especially with reports of more than 200 still waiting for their flogging sentence to be carried out.
Amnesty International has now commented on the issue, saying it is disturbing and the Maldives government should ensure that it adheres to the instruments it has ratified and ban flogging.
In an interview with Dhivehi Observer, Mr. Abbas Faiz, Amnesty International's researcher on the Maldives outlined the organizations position on flogging in the Maldives.
“The news that an 18-year-old woman was recently flogged in public outside the Justice Building and sentenced to a year of house arrest for having extramarital sex is disturbing,” said Mr. Faiz.
“Fogging is a direct example of torture and cruel, inhuman or degrading punishment which is prohibited in international law,” he added.
“The government of Maldives is obliged to abolish this punishment under the international human rights instruments in has ratified such the Convention against Torture,” he added further.
There are serious flaws in the criminal justice system of the Maldives and despite repeated calls from human rights organizations to bring the country’s justice system into conformity with human rights standards, very little has been done so far. “ Mr. Faiz continued.
“It is the responsibility of the government of Maldives to ensure that no one is sentenced to flogging, and no one is subjected to flogging,” according to Mr. Faiz.
He also added that “the law is specifically discriminatory against women. Official figures suggest the vast majority of people who are flogged are women. This shows that the law is specifically targeting women.”
The argument that flogging is ordained under Shari’a law is undermined by the fact that many Muslim countries have abolished flogging. This punishment can also be abolished in the Maldives, says Mr. Faiz.
“Amnesty International urges the government of Maldives to first of all impose as a matter of urgency a moratorium on flogging in the country so that no sentence of flogging is carried out. At the same time, the government should act immediately to abolish this cruel, inhuman and degrading punishment altogether.” Mr. Faiz concludes.

If we are to carry out basic punishments for the 'haraam' acts, half the young population will need to be punished. Sex with your partner before marriage, drinking, failing to perform prayer 5 times, etc.
We need to look into the root cause. Do we REALLY believe in this religion. If not, (and there is nothing wrong with that) why not change constitution (it is inevitable) and make it not unconstitutional for whose who wish to step aside, even for a while.

When you are concerning with Maldives going against International Law, I wonder what you know about International Law. From where and when did International Law was derived. It was only formed after the first world war, before that there was nothing called International Law. International Law has no obligatory powers up on any sovereign country unless they decide to follow the law by their own will, meaning after they sign the treaties.
International Laws are derived from treating made between the countries, esp during post war period. It is also derived from international customary and practices. So, basically it is just an evolution of customs and treaties.

Maldives is muslim country by name only besides having many mosques. In reality maldivians do have free sex, drink and do everything prohibited in Islam.
I think to save this country from it current mass problems of rape, adultery, sexual abuse on kids and coworkers, robbery, drugs, gang fights and tonnes of other things, islamic law will certainly help. That 18 year old should not be punished if there were no 4 witness.Besides the 2 guys did'nt admit so if they are deemed to be not guilty then she is also not guilty even if she is carrying a child. Nowhere in Quran it says punish the pregnant women. Quran says punish if you have 4 witness. So it is the goverment's duty to have islamic affairs officers doing rounds to check if such activities being done. Robbers should be punished by cutting off their hands but they must be punished only if they are proved to have robbed. Drug dealers should be hangged to death, they ruin so many people. But again only if they are proved guilty.
Quran says marry 2, 3 or 4 but if you cannot be fair than stick to one. But it also says a few page after that man cannot be fair so don't be cruel to your wife. Why do men just read the 1st verse and claims it is his rights to have 4 wives. In Maldives it's a in thing to marry as many as you can. This also should be restricted unless they can prove they can be fair to all their wives. If the wife do not agree to let her husband take another wife, then her plea should not be ignored. The husband can then choose to keep his wife or divorce her to marry another if she do not agree and he still wants to take another wife. Sadly most wives silently suffer psychologically and live in pain. While their husband goes around boasting that all his wives are happy indeed.
What i am trying to say here is that quran do guide us but men misinterpret them to their own use such as punishing a pregnant women but not the man who caused the pregnancy. Why the double standard when it comes to religious rights and punishments.

Amnesty International does a great job in prompting human rights however they should keep in mind that they can not ask us to follow some convention or their way of thinking agianst the Laws of Islam. They should try to promote Human rights with the bounds of Islam, if they are so worried about human rights in Maldives. If they can't do that they better keep their lips tight.

Adultery is the act of sexual intercourse between a man and woman who are not married to one another. Any accusation of adultery will not be accepted unless four eyewitnesses are produced to support the adultery charges. The witnesses must have seen the act of sexual intercourse first-hand (hearsay, circumstantial or another non-direct evidence will not be accepted). In case four true witnesses are presented, then the court will issue the required sentence of 100 lashes for both the man and woman involved in the adultery. The lashings must be publicly witnessed to cause embarrassment to the guilty parties. In case four witness are not presented or the witnesses are not all found to be true, then the person who brought forth the accusation and the persons who gave false testimony will be lashed 80 lashes each and will be refused future testimonies with the court unless they have repented.
Accusations of Adultery by Husband/Wife
“And those who accuse their spouses, but they have no witnesses except for themselves, then the testimony of one of them is to be equivalent to that of four witnesses if it is sworn by God that they are being truthful. And the fifth shall be the curse of God upon themselves if they are of the liars.” (Qur’an 24:6-7)“And the punishment will be averted from her if she bears witness four times by God that he is of the liars. And the fifth shall be the curse of God upon her if he is speaking the truth.” (Qur’an 24:89)
A man or woman may accuse his/her spouse of adultery in court without having any witnesses except themselves if they swear an oath by God four times to such effect. However, in cases of the husband accusing his wife, she will be able to counter and nullify his accusation if she swears an oath by God four times that he is lying. The punishment in such case of adultery as stipulated under the court authority would be 100 lashes in public.

In order to establish the notion of "Islam is sound for all places and times" and can tolerate pluralism in its structure, Dr. Mohammed Shahroor - (born in 1938 in Damascus) an Emeritus Professor of Civil Engineering at the University of Damascus who writes extensively about Islam had introduced a new theory of legislation called the "Theory of Limits", i.e. God's Limits (Hudud). Human legislation is permitted within (in between) these limits. The Theory of Limits may be described as follows: It is the divine decree, expressed in the Book and the Sunna, which sets a lower limit or an upper limit for all human actions and natural phenomena. Within these limits, human-based legislation can take place. If we look to verses in the Book, he states, we can distinguish six types of limits and Zina or Adultery falls under the fourth type of God’s limits, as hereunder :
4 - The fourth type of God's limits is when the upper and the lower limits meet together. It has been found that in all the Book and the Sunna only one verse is of this type (sura24 verse2) which states: "The adulteress and the adulterer, scourge ye each of them with a hundred lashes and let not pity for the twain withhold you from obedience to God, if ye belief in God and the last day, and let a party of the believers witness their punishment". Here the upper and the lower limits are set at one meeting point, namely, one hundred lashes. This is the only case in Islamic legislation where we got a line without field of movement.

Sura Noor (Chapter 24) which was one of the last Sura's revealed has prescribed only 100 flogs for adulterer and adulterous.There is no proof stoning was carried out after this Sura.
